Definitions

KVKK: Personal Data Protection Law No. 6698

Personal Data: Any information, including those included in the personnel file, regarding an identified or identifiable natural person/employee, such as identity, address, telephone, e-mail, ID number, driver's license number, passport number, etc.

Protection of Personal Data: According to the KVKK numbered 6698, any information that enables a natural person to be identified or identifiable is considered personal data. We would like to inform you about the processing purposes, legal reasons, collection methods, to whom and for what purposes your personal data at AkademiNewYork can be transferred, and the rights granted to you under the KVKK, both in connection with and independent of these, as explained below.

  1. Data Controller and Personal Data Categories

Pursuant to the Personal Data Protection Law No. 6698 (“Law No. 6698”); your data regarding identity information, contact information, information that may be included in the content of the message you send us, marketing information, and transaction security information may be processed by AkademiNewYork (“Company”) as the data controller, within the scope detailed below.

  1. Methods of Collecting Personal Data

The Company, acting as the data controller, collects your identity and contact information such as name-surname, telephone, e-mail, address, etc. in the contact form you fill out on the website and your personal data that may be included in the message you send to us, through written or electronic methods based on explicit consent, within the framework of legal reasons that arise and are implemented based on the relevant legislation, contract, demand, and honesty rules, in order to provide you with our quality services and to carry out our business activities within this framework, in accordance with our legal obligations arising from the KVKK and other relevant legislation.

  1. Purposes of Processing Personal Data

Your personal data collected within the scope of the contact form is processed for the limited purposes of evaluating the messages you send, meeting your requests, creating, processing and finalizing your request, meeting your information requests regarding our services, conducting communication activities, following up on requests/complaints and conducting service processes, depending on your request in the contact form.

  1. Transfer of Personal Data

Your personal data is transferred to our group companies, business partners, suppliers, legally authorized public institutions and private individuals, provided that your explicit consent is obtained or under the conditions that “data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person”. However, your personal data is transferred to our business partners, legally authorized public institutions and private individuals residing abroad, provided that your explicit consent is obtained or provided that they are located in countries with sufficient protection/reliable countries as announced by the Personal Data Protection Board, without your explicit consent.

As stated above, the Company may only transfer your personal data in question; domestically based on your explicit consent or within the framework of the security and confidentiality principles specified in Law No. 6698 and the relevant legislation, provided that sufficient measures are taken, and abroad, provided that the necessary security measures are taken, for the conduct of the Company's activities; Our business partners, business contacts and stakeholders may share your personal data with the information technologies we use, servers located in Turkey or abroad and companies that provide support for these servers, domestic/international persons and institutions from whom we receive physical servers and/or cloud services, suppliers that process data on behalf of our Company, or public institutions or organizations authorized to request this data due to a legal obligation, including, but not limited to, other relevant authorities.

  1. Source and Legal Reason

Your personal data collected by you via electronic media, written or verbal data transfer via the website is collected and processed based on the legal grounds of “data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person” specified in Article 5/2-f of the KVKK No. 6698 and your explicit consent specified in Article 5/1, for the purposes specified in Article 3 of this text, to protect the rights and interests of the relevant person, to provide you with rights and interests for the establishment of a business relationship, to maintain and develop the in-house activities and to fulfill the obligations arising from the legislation.
